Lawsuit challenging SB 1070 inches ahead in U.S. court: "A lawsuit filed by a group of Arizona residents and non-profits challenging Senate Bill 1070 inched ahead Monday as U.S. District Judge Susan Bolton set deadlines for various motions and discovery related to plans by the plaintiffs to try to turn the case into a class- action lawsuit as well as an effort by the defense attorneys representing the state and counties to challenge some of the plaintiffs' legal standing.
The success of part of this case will hinge on whether the U.S. Supreme Court decides to hear the other major suit filed against the immigration law, that one by the federal government.
The state is asking the high court to overturn Bolton's 2010 ruling in that case, which halted parts of SB 1070 from going into effect. The Supreme Court will likely decide sometime this fall whether to hear the case. If it decides to, it could hear it sometime next spring. A ruling would be expected by next summer.
Bolton said the non-profits' case could advance with other issues while everyone waits on the Supreme Court."
